1. Accepting These Terms
This document and the other documents that we reference below make up our Terms and Conditions (the “Terms” for short).
These Terms are a legally binding contract between you, as a User, and Dave Conservatoire (operated by Pentachord Ltd.).
This contract sets out your rights and responsibilities when you use Dave Conservatoire's services (“Services”). If you don’t agree with the Terms, you may not use our Services.
2. Provisions of Service
Dave Conservatoire will use its reasonable endeavours to provide the Services on an error-free basis and without interruption. Notwithstanding, Dave Conservatoire does not provide any guarantee that provision of the Services will be error-free or without interruption and reserves the right to alter or suspend provision of the Services without prior notice to Customers. By accepting these Terms and Conditions, you acknowledge that the Services may change in form or nature at any time.
By accepting these terms you agree that Dave Conservatoire shall have the right, exercisable at its sole discretion, to terminate provision of the Services without prior notice to Users.
3. Your Account with Dave Conservatoire
You will need to create an account with Dave Conservatoie to use many of our Services. We expect you to abide by the following rules and failure to do so may result in your account being permanently closed.
Use your account honestly
You must give us accurate information when creating your account and using the service. You may not impersonate another person, or provide false or misleading information about yourself.
You must take responsibility for every action taken while logged in under your username and password. We have the right to disable any user accounts, at any time, if in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.
Keep your account secure
We expect you to take reasonable steps to keep your account information secure. Sharing your login or purchase information with others is forbidden. We have the right to disable any account whose information we suspect has been shared or been compromised.
4. Payments and Memberships
Access to the Services is made via online payments.
The cost associated with each membership plan will be indicated on the payment page.
If you choose to start a membership plan and provide or designate a payment method, you authorize Dave Conservatoire to charge you a membership fee on a recurring basis depending on your chosen membership package.
We reserve the right to modify or withdraw and of our membership models in any manner and at any time. If we are changing your ongoing membership, you will be notified via email before the price change takes effect.
A one-time payment for access to the Services will remain valid while the Services are in operation, subject to the provisions of service set out in Section 2.
Some payments may be time limited and may expire on a date made clear during purchase.
Cancellations
You may cancel your ongoing membership at any time without any prior notice, and therefore, cancel any recurring payment plans. Failure to cancel before the next billing date will result in another automatic payment.
5. Refunds
Before making a purchase you should ensure that Services you are buying are appropriate to your needs. EU consumers may request a refund on digital download content for 14 days after purchase, except where Dave Conservatoire's performance of its obligations have begun. By clicking "Subscribe" or "Buy Now" you agree that Dave Conservatoire provides you with immediate access to digital content as soon as you complete your purchase, without waiting the 14-day withdrawal period. Therefore, you expressly waive your right to withdraw from a purchase.
All refunds are at the sole discretion of Dave Conservatoire, and Dave Conservatoire reserves the right to refuse a request for refund at any time.
6. Your Use of Our Services
License to Use Our Services.
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services, subject to the Terms and the following restrictions in particular:
Don’t use our services to break the law.
You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal, and international laws that may apply to you.
Don’t steal the content.
You agree not to download, decipher, decompile, “crawl,” “scrape,” or “spider” any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.
Don’t try to harm our systems.
You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.
7. Your Privacy
We appreciate that our Customers and Merchants have requirements under GDPR that are directly impacted by their use of Dave Conservatoire’s services, and we are committed to helping our Customers fulfil their requirements under GDPR. Read our privacy policy.
